This User Content Guidelines (hereafter the “Guidelines”) formulate binding behavioral standards, uniform criteria and unified conduct codes binding all platform content, user accounts and interactive activities occurring on [Picshub] (the “Software” or “Mobile Application”). The Guidelines function as supplementary contractual annexes to the Terms of Service, furnishing detailed stipulations distinguishing permitted behaviors and prohibited acts within the platform community. The Application operator undertakes to develop a secure, all-embracing and creative online space wherein users may freely express personal opinions while assuming corresponding liabilities to other individual users and the whole community.
1.1 All parties accessing, utilizing or engaging with the Application’s functions, content resources and service offerings shall be governed by these Guidelines, including without limitation natural persons, legal entities and institutional organizations.
1.2 Every piece of material generated, imported, uploaded, transmitted, published, algorithmically produced, received or stored by users through the Software or platform Services (including content generated by the platform’s artificial intelligence tools if available) shall be subject to these Guidelines. Such materials cover, without limitation, photographs, video footage, written text, profile avatars, audio recordings and other associated materials, collectively designated as “User Generated Content”.
All provisions set forth in these Guidelines are built upon the following core operational precepts adhered to by the Application:
2.1 Harm Mitigation – The platform prioritizes the safety and mental wellness of all community participants and implements proactive oversight mechanisms to detect, block and remove content likely to inflict physical or psychological damage on any individual or collective group.
2.2 Protected Creative Expression – The platform acknowledges and safeguards users’ entitlement to creative self-expression, provided that such expression does not breach applicable statutory laws, these Guidelines or the lawful rights and interests of third parties.
2.3 Inclusiveness and Mutual Dignity – The platform commits to sustaining an inclusive community environment where every user is treated with equal dignity and courtesy, free from discriminatory treatment, persistent harassment and hate-driven behaviors.
No user shall generate, upload, circulate or spread any content, nor engage in any conduct, falling under the following forbidden classifications:
3.1.1 Content advocating, glorifying or inciting violent conduct, including threats of physical harm, organized violent clashes and terrorist operations.
3.1.2 Content portraying or encouraging participation in violent acts capable of causing death, severe bodily harm, substantial property loss or disruption of public order.
3.1.3 Content facilitating or supplying step-by-step instructions for manufacturing or utilizing firearms, explosives and other hazardous dangerous goods.
3.2.1 Content aiding the sale, exchange and distribution of illegal narcotics, controlled psychotropic substances and restricted prescription pharmaceuticals.
3.2.2 Content facilitating transactions, circulation and distribution of firearms, ammunition and other weaponry in contravention of applicable local laws and regulatory rules.
3.2.3 Content promoting or supporting human trafficking, cross-border smuggling and other illegal criminal operations.
3.3.1 Content attacking, threatening or stirring hatred against specific individuals or demographic groups on grounds of race, ethnicity, national origin, religious faith, gender, gender identity, sexual orientation, disability or any other legally protected personal attribute.
3.3.2 Content propagating supremacist ideologies, or advocating the exclusion, segregation and subjugation of any identifiable social group.
3.4.1 Content crafted to target, intimidate or humiliate specific individuals or collective groups.
3.4.2 Content constituting cyberbullying, doxxing (disclosing private or identifying personal data without prior consent), or offering support for harassing behaviors.
3.4.3 Content adopting altered spellings, homophones, symbols, numerals and other obfuscation methods to evade platform content moderation and carry out harassing or harmful acts.
3.4.4 Beyond general harassment, the following content is strictly banned on the Application:
(a) objectification or dehumanization of individuals based on race, ethnicity, religion, gender, sexual orientation or disability;
(b) racially biased remarks that carry demeaning, exclusionary or derogatory implications (e.g., posting “No [race/ethnic group]” on public profiles to advance discrimination);
(c) unsolicited sexual advances or explicit sexual materials sent to users who have not demonstrated consent or interest;
(d) continuous messaging after the target user has clearly declined communication requests or blocked the sender; and
(e) utilizing the Application to gather other users’ personal data for stalking, doxxing or off-platform harassment.
3.5.1 Content disseminating false or deceptive information that may bring substantial harm to individuals, public health or public safety.
3.5.2 Content involving deceptive practices, including identity impersonation, fraud, phishing and fraudulent schemes of all forms.
3.5.3 Content utilizing the portrait, likeness, full name or personal data of any individual (including public figures, celebrities and ordinary platform users) without the subject’s explicit written consent and authorization, regardless of whether the purpose is personal use, commercial promotion or brand endorsement.
3.5.4 Misleading AI-generated or AI-modified content without conspicuous marking and disclosure of its synthetic nature.
3.5.5 AI-Generated Profile Avatars. Users are prohibited from adopting artificial intelligence-generated, synthetic or substantially altered images as their primary profile photographs or avatars on the Application. All profile pictures must truthfully and authentically reflect the user’s real physical appearance. Users may post AI-generated materials within photo albums or story sections only if such materials bear prominent, visible labels reading “AI-generated” or “Synthetic” within captions or descriptive text attached to the images.
3.5.6 Content impersonating, falsely claiming official affiliation with, or misrepresenting a relevant connection to the platform operator, its parent corporation, subsidiaries, affiliated entities, staff, contractors, customer service representatives, content moderators and all other internal personnel. This provision includes, without limitation, unauthorized use of the platform’s name, logos, brand marks and employee names to defraud or mislead other users.
3.6.1 Content depicting, promoting or facilitating sexual exploitation, including child sexual abuse material, non-consensual sexual content and acts of sexual violence. 3.6.2 Content portraying or promoting pornographic, sexually explicit materials and sexual solicitation activities.
3.6.3 Content depicting sexually suggestive behaviors involving minors. 3.6.4 Content promoting, facilitating or soliciting paid sexual services, including without limitation prostitution, escort services, compensated dating, sexual acts exchanged for cash, gifts or other valuable consideration, alongside content advertising or linking to external platforms offering such unlawful services.
3.6.5 Content sharing, threatening to share or requesting intimate or sexually explicit photographs and videos of any individual without the subject’s fully informed, voluntary and explicit consent.
3.7.1 Content depicting or promoting activities carrying substantial risks of severe bodily injury or death.
3.7.2 Content encouraging self-harm, eating disorders and other behaviors endangering users’ physical and mental health.
3.8.1 Content that infringes third parties’ copyrights, trademarks, patents and other intellectual property rights.
3.8.2 Content facilitating unauthorized distribution of works protected under copyright law.
3.9.1 Content classified as spam, including repetitive, irrelevant and unsolicited commercial communications.
3.9.2 Content manipulating the Application’s data metrics, such as fake engagement data, automated bot operations and coordinated inauthentic user behaviors.
3.9.3 Content interfering with the platform’s generative artificial intelligence tools and other core technical systems.
3.9.4 Content or conduct involving unauthorized scraping, crawling, data harvesting, data mining and mass downloading of other users’ content, profile information, images and personal data from the Application, whether through automated tools (bots, scripts, crawlers) or manual collection, for any objective including but not limited to building derivative databases, conducting competitive industry analysis or republishing materials on third-party platforms, absent the platform’s prior written explicit authorization.
3.9.5 Content or conduct utilizing the Application to promote, sell or advertise goods, services and commercial opportunities without valid legal permits, or otherwise violating applicable laws and regulatory provisions.
Users acknowledge and agree that, pursuant to the Terms of Service, all content uploaded, posted or otherwise published by users on the Application (including photographs, videos, written text, profile avatars and activity logs) may be utilized by the platform operator for commercial promotion, marketing campaigns, advertising and brand development of the Application and its affiliated products and services, under a perpetual, irrevocable, global, royalty-free, sublicensable and transferable license. Full details governing the platform’s commercial exploitation of User Generated Content are stipulated within the Terms of Service.
5.1 Any user who discovers content or conduct posing potential risks to minors is strongly urged to submit an immediate report via [apple@picshubeditor.com
]. The platform shall prioritize the review of all reports involving potential harm to minors.
5.2 The platform reserves the absolute right to permanently close any accounts held by users under eighteen (18) years of age, or accounts confirmed to have violated minor protection provisions.
5.3 Adult users (individuals aged eighteen (18) or above) are prohibited from soliciting, requesting or encouraging any user whom they know or have reasonable grounds to believe is under eighteen (18) years old to disclose personal contact information, private images or arrange offline in-person meetings.
5.4 Adult users are strictly forbidden to send sexually explicit, suggestive or otherwise inappropriate content and communications to users whom they know or reasonably suspect to be minors under eighteen (18) years of age.
Where a user holds the belief that their intellectual property rights have been infringed by content hosted on the Application, as defined under Section 3.8 herein, such user may submit a formal infringement notice to the platform operator. The platform shall process all submitted notices in full compliance with applicable intellectual property statutes. Users repeatedly committing intellectual property infringements shall face account suspension or permanent termination. If a user deems their content was removed mistakenly or due to wrongful identification, the user may file a counter-notice. For complete procedural rules, document requirements for infringement notices and counter-notices, as well as users’ legal rights and corresponding obligations, refer to Section 11 of the Terms of Service.
7.1 The platform adopts a dual oversight system combining automated content moderation technology and manual review by professional safety personnel to identify, examine and impose corrective measures against content violating these Guidelines.
7.2 Upon confirming that specific content or user conduct violates the provisions herein, the platform may implement one or multiple of the following enforcement measures: (a) Removal of the violating content or restriction of public access to such content; (b) Issuance of a formal written warning to the violating user; (c) Temporary suspension or permanent termination of the user’s platform account; (d) Restriction of partial functional permissions available to the violating user; (e) Referral of relevant case materials to competent law enforcement authorities if the identified conduct constitutes criminal offenses.
8.1 Users may report content or conduct suspected of violating these Guidelines by contacting the platform via [apple@picshubeditor.com].
8.2 Users subject to platform enforcement actions against their content or accounts may file a formal appeal by sending an email to [apple@picshubeditor.com]. All appeals must be submitted within thirty (30) calendar days following the date of the enforcement action. The platform shall send a receipt confirmation within forty-eight (48) hours upon appeal submission and deliver a formal ruling within seven (7) business days. If the initial appeal is rejected, the user may apply for secondary review, which shall be finalized within fourteen (14) business days. The platform shall provide written explanations outlining the grounds for its final ruling. Users filing three (3) or more groundless frivolous appeals within a ninety (90) day cycle shall be barred from submitting new appeals for a period of six (6) months.
The platform retains the unilateral right to revise, update and modify these Guidelines from time to time to adapt to evolving user community behaviors, newly emerging safety risks and adjustments to applicable laws and regulatory rules. A user’s continued access to and utilization of the Application following regulatory amendments shall constitute unconditional acceptance of the updated Guidelines.
10.1 These Guidelines shall be construed in conjunction with the Terms of Service and applicable statutory laws of the jurisdiction governing the legal relationship between the user and the platform operator.
10.2 In the event of any inconsistency between these Guidelines and the Terms of Service, the provisions of the Terms of Service shall prevail.
